THIS IS AN AGREEMENT BETWEEN THE END USER AND MUSSIO VENTURES LTD., DBA BACKROAD MAPBOOKS, BACKROAD MAPS AND BRMB MAPS

IMPORTANT - READ CAREFULLY BEFORE USING THIS WEBSITE OR APPLICATION. BY USING THIS WEBSITE OR APPLICATION, YOU AGREE WITH THESE TERMS OF USE.

The BRMB Maps End User Terms of Use govern your use of the BRMBmaps.com website and its components, and the BRMB Maps App and associated apps, such as the Algonquin Park Adventure Map app, which consist of mapping and related services provided by Backroad Mapbooks, located at Unit 106–1500 Hartley Ave, Coquitlam, BC, V3K 7A1, Canada, and all its affiliates. These Terms of Use do not apply to third-party content referenced by BRMBmaps.com and the BRMB Maps App and associated apps. Your use of the BRMBmaps.com, BRMB Maps App and associated apps constitutes your agreement to all provisions of these Terms of Use.

MODIFICATION OF THESE TERMS OF USE

Backroad Mapbooks reserves the right to change the Terms of Use under which the BRMBmaps.com, BRMB Maps App and associated apps are offered, including the right to add new terms. You are responsible for regularly reviewing the terms, conditions and notices of these Terms of Use, and any modified or additional terms, conditions or notices that may be included on or with any content available on the BRMBmaps.com, BRMB Maps App and associated apps. Your continued use of the BRMBmaps.com, BRMB Maps App and associated apps constitutes your agreement to all such terms, conditions and notices.

SCOPE OF PERMITTED USE

The BRMBmaps.com, BRMB Maps App and associated apps are for your individual personal use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, sublicense, transfer, assign, rent, sell or otherwise convey any information, content, software, products or services obtained from the BRMBmaps.com, BRMB Maps App and associated apps without the prior written consent of Backroad Mapbooks. Backroad Mapbooks is not responsible for any form of transmission received from any linked third-party websites, nor is Backroad Mapbooks responsible if the linked third-party website is not working properly. Backroad Mapbooks is not responsible for the content of linked third-party sites and does not make any representations or warranties regarding the content or accuracy of materials on such third-party websites or the privacy practices of such third parties. If you decide to access linked third-party websites, you do so at your own risk. The BRMBmaps.com, BRMB Maps App and associated apps are not to be used for purposes that are considered to be unlawful or prohibited by these Terms of Use. The BRMBmaps.com, the BRMB Maps App and associated apps are NOT to be used in any manner that could damage, disable, overburden, or impair the BRMBmaps.com, the BRMB Maps App and associated apps or interfere with any other party's use and enjoyment of the BRMBmaps.com, the BRMB Maps App and associated apps. You may not attempt to gain unauthorized access to the other accounts, computer systems or networks connected to the BRMBmaps.com, and BRMB Maps App and associated apps through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the BRMBmaps.com, the BRMB Maps App and associated apps.

By using the BRMBmaps.com, and BRMB Maps App and associated apps I agree to waive any right I have in law for any cause of action including, but not limited to, any tort, breach of contract or defamation claim.

Backroad Mapbooks does NOT warrant that the BRMBmaps.com, BRMB Maps App and associated apps will operate error-free or that the BRMBmaps.com, BRMB Maps App and associated apps are free of computer viruses and other harmful goods. Your use of the BRMBmaps.com, and BRMB Maps App and associated apps is at your own risk. If you are dissatisfied with any of the content or other contents of the BRMBmaps.com, and BRMB Maps App and associated apps or with these terms and conditions, your sole remedy is to discontinue the use of the BRMBmaps.com, and BRMB Maps App and associated apps. Backroad Mapbooks may from time to time monitor your use of the BRMBmaps.com, and BRMB Maps App and associated apps and collect, store, use and disclose information about you. You hereby consent to such collection, storage, use and disclosure. INDEMNIFY

You agree to defend, indemnify, and hold harmless Backroad Mapbooks, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your breach of these Terms of Use.

Privacy Policy

This Privacy Policy covers Backroad Mapbooks' use and disclosure of your personal information and other information, which is collected through or in connection with the BRMB Maps APP and/or BRMBmaps.com and associated apps such as the Algonquin Park Adventure Map app. For the purposes of this Privacy Policy, reference to the BRMB Maps APP and/or BRMBmaps.com includes all the web and App pages related to and/or included in the BRMB Maps APP and/or BRMBmaps.com, excluding any links to third-party sites, Apps, Promotions or Services.

Except as set out in this Privacy Policy, Backroad Mapbooks will not disclose any personally identifiable information without your permission unless we are legally entitled or required to do so (for example, if required to do so by legal process or for the purposes of prevention of fraud or other crime) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers, etc. In the event that our company, or part thereof, is acquired by another company, that company may use your personal data in accordance with this Privacy Policy.

Backroad Mapbooks collects personal information from you only with your knowledge and consent to help meet our commitment to provide excellent service and to continuously improve your experience on the BRMB Maps APP and/or BRMBmaps.com and associated apps. Information about a mobile device, including universally unique ID ("UUID"), Platform type and version (e.g. iOS or Android), carrier and country location, hardware and processor information (storage, chip speed, camera resolution, NFC enabled, and network type [Wi-Fi, 2G, 3G, 4G]); and
Activity and usage information occurring via the BRMB Maps APP and/or BRMBmaps.com and associated apps, including User Tracks, Waypoints/Markers, Trip Descriptions, tagging data, favourites, survey responses, preferences, session lengths; and similar data.

Use of Cookies
Information that we collect using "cookie" technology. Cookies are small packets of data that a website stores on your computer's or mobile device's hard drive so that your computer will "remember" information about your visit. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to help us collect Other Information and enhance your experience using the Platform. If at any time the BRMB Maps APP and/or BRMBmaps.com and associated apps offer any chat rooms, notice board facilities, newsgroups etc. we may collect the information that you disclose. Such information will be used in accordance with this Privacy Policy. Please note that we cannot be responsible for other parties' use of the personal information, which you make available to such third parties through any chat room, notice board, newsgroup etc. on the BRMB Maps APP and/or BRMBmaps.com and associated apps. If at any time BRMB Maps APP and/or BRMBmaps.com and associated apps offer any e-mail, feedback or forum facilities, we may collect the information, which you disclose. Such information will be used in accordance with this Privacy Policy.
